Z-Health Performance Courses: Comprehensive Terms, Conditions, and Policies (Including Online and In-Person Events)
1. General Terms and Conditions
- Scope: These terms apply to all Z-Health courses and programs, including specialized courses and online and in-person events.
- Legal Agreement: Participation in any format signifies entering a binding legal agreement with Z-Health.
2. Payment Terms
- All payments must be in US Dollars.
- Pre-Payment Requirement: Full payment is required before accessing any course, product, or program.
- International Fees: International participants are responsible for additional customs duties, taxes, and transfer fees.
- Refund Policy: Courses, products and programs are nonrefundable once digital access has been granted
- In the event a refund has been approved for an extenuating circumstance, access to all digital materials related to the course(s) will be removed from your account. This will be a one-time courtesy and will be noted in your account. Any future purchases will not be eligible for a refund regardless of the circumstance.
- Regardless of circumstance, no refunds will be granted on digital course materials after 30 days of purchase, or upon completion of the certification.
3. Membership and Subscriptions
- The Brain-Based Practitioner’s Guide Professional Membership purchase is for 1 year of access, and locks in your renewal rate.
- A current membership is needed to view content.
- The membership will autorenew and requires a payment method on file that will be autocharged on the renewal date.
- Memberships will autorenew at the initial purchase rate.
- Cancellation requests must be submitted via email before the membership renews.
- Repeated failed payments will result in a canceled membership.
- A lapse in membership voids the rate lock and renewals will be at the current retail price.
- Alternate forms of payment (Z-Bucks, PayPal, Bank Transfer) are accepted, and must be requested before the renewal date.
4. Payment Plan Terms
- Availability and Conditions: Payment plans are subject to Z-Health’s approval
- All payment plans require a credit card on the account to be enrolled in autocharge.
- Maximum payment plan length: 6 months
- Course Access will be granted upon full payment completion.
- Nonrefundable Period: Payments become non refundable after 3 months. Payments will stay on the account as a nonrefundable deposit.
5. Refund Process
- Method: Refunds are issued to the original payment method or via PayPal/Bank Transfer.
- Fees: Participants bear transaction fees.
- Processing Time: Up to 6 weeks.
6. Professional Advice Disclaimer
- Limitation of Scope: Z-Health’s courses are not substitutes for professional advice in any field.
7. Limitation of Liability
- Liability Cap: Liability is limited to the fees paid for the course.
- Exclusions: Z-Health is not liable for indirect or consequential damages from course participation or materials use.
8. Indemnification
- Liability Release: Participants indemnify Z-Health against claims related to course use or agreement violations.
- Ongoing Obligation: These indemnifications outlast the agreement.
9. Confidentiality and Non-Compete
- Proprietary Material Use: Unauthorized use, distribution, or teaching of course materials is prohibited and legally actionable.
10. Intellectual Property Clause
- Restrictions on Repackaging: Repackaging, reselling, or redistributing the curriculum to other professionals is strictly prohibited. Violations will be legally pursued.
11. Online Course Specific Rules
- Technical Requirements: Participants are responsible for their own internet access and compatible hardware.
- Participation Etiquette: Professional conduct and respect are expected in online interactions.
12. Live Event Specific Rules
- Conduct at Events: Respect and professionalism are mandatory. Disruptive behavior may lead to removal without refund.
- Venue Policies: Attendees must adhere to specific rules and regulations of the event venue.
13. Solicitation Policy
- Prohibited Uses: Information obtained from Z-Health cannot be used for unauthorized commercial, political, or solicitation purposes.
14. Youth Policy
- Age Limitations: Strict age-related restrictions apply for both online and live courses.
15. Adult Language/Content Warning
- Content Nature: Courses may include adult themes and language.
16. Audio/Visual Rules
- No Unauthorized Recording: Personal recording at live events or online sessions is prohibited.
17. Privacy Policy and Earnings Disclaimer
- Privacy Acknowledgment: Participation implies agreement with Z-Health’s Privacy Policy.
- No Earnings Guarantee: Results and earnings from courses are not guaranteed.
18. Disabilities Accommodation
- Accessibility Request: Contact Z-Health 30 days prior for necessary accommodations in both online and live formats.
19. Event Cancellation Policy
- Cancellation Rights: Z-Health reserves the right to cancel events, offering rescheduling options where possible.
20. Jurisdiction and Updates
- Governing Law: Governed by Nevada law, with dispute resolution in Clark County.
- Agreement Updates: Subject to change without prior notice.
21. Miscellaneous
- Binding Agreement: This document represents the authoritative agreement between participants and Z-Health. It includes assignment constraints and a waiver clause for certain breaches.
INFORMED CONSENT WAIVER AND RELEASE OF LIABILITY
In consideration of participating in the training offered by Z-Health Performance Solutions, LLC (the “Company”) and its certified Trainers (the “Training”), I acknowledge, understand, and agree to the following terms. This Informed Consent Waiver and Release of Liability (the “Release”) applies to all Training activities and locations.
1. HEALTH AND MEDICAL RESPONSIBILITY
- I understand that it is my responsibility to consult with a physician before participating in any Training.
- I acknowledge that I am responsible for fully disclosing my medical history to my instructor, including but not limited to injuries, surgeries, medications, supplements, and any medical or health-related conditions.
2. ASSUMPTION OF RISK
- I acknowledge that Training may include physical activities that carry inherent risks, including but not limited to the risk of serious injury, disability, paralysis, or death.
- I understand that these risks may arise from my own actions or inactions, the actions or inactions of others, the condition of the premises or equipment, or other factors.
- I voluntarily assume all risks related to my participation in Training, including those that may arise from the ordinary negligence of the Company, its employees, independent contractors, or other participants.
I UNDERSTAND THAT THIS ASSUMPTION OF RISK INCLUDES RISKS OF INJURY TO MY NECK, BACK, SPINE, SHOULDERS, KNEES, OR OTHER PARTS OF MY BODY.
3. RELEASE OF LIABILITY
- In consideration of my participation, I hereby release, waive, and discharge the Company, its employees, independent contractors, agents, trainers, members, managers, officers, and volunteers (the “Company’s Agents”) from any and all claims, demands, and causes of action for injuries, damages, or death that I may suffer as a result of participating in the Training.
- This release includes claims arising from the ordinary negligence of the Company or the Company’s Agents.
- This release does not apply to claims of gross negligence, intentional misconduct, or willful disregard for safety.
4. INDEMNIFICATION
- I agree to indemnify, defend, and hold harmless the Company and its Agents from any claims, losses, or damages, including legal fees, resulting from my participation in the Training.
5. MEDICAL CONSENT
- I understand that the Company’s staff are not medical professionals and cannot provide medical treatment.
- In the event of an injury or illness during Training, I authorize the Company’s staff to provide temporary aid and to contact emergency medical services if deemed necessary.
- I release the Company from any liability related to medical care provided or delayed.
6. CHOICE OF LAW AND VENUE
- I agree that this Release shall be governed by the laws of the State of Nevada.
- Any disputes arising from this Release shall be resolved exclusively in the state or federal courts located in Clark County, Nevada.
7. SEVERABILITY
- If any provision of this Release is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
8. PARENTAL CONSENT (IF APPLICABLE)
- If the participant is a minor (under 18 years of age), I, as the parent or legal guardian, consent to the minor’s participation in Training.
- I assume all risks on behalf of the minor and agree to all terms of this Release. I further agree to indemnify and hold harmless the Company from any claims arising from the minor’s participation.
9. ACKNOWLEDGMENT OF UNDERSTANDING
I HAVE READ THIS INFORMED CONSENT WAIVER AND RELEASE OF LIABILITY. I UNDERSTAND THAT I AM GIVING UP CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE. I SIGN THIS AGREEMENT FREELY AND VOLUNTARILY, WITHOUT ANY INDUCEMENT, DURESS, OR COERCION.
